The issue with the fines isn't basing it on salary, it's the cap that the NHLPA has negotiated.
The thing is, they're not going to give that up unless they get something back, and why would the owners really care?

The money doesn't go to them anyway, it is added to the Players Emergency Assistance Fund
(now, whether the current players should be considering that in their negotiations is a different story)
